Riverside Violent Crimes Attorney
Armed Robbery
Robbery is the crime of stealing another person's property through the use of violence or threats. Armed robbery is theft with the use of a weapon. Armed robbery is common in urban areas, and in some cases, can result in death. In all instances of robbery, force is used. Force is what differentiates robbery from embezzlement or fraud, even though they are all considered types of theft. If no threats are issued, or force is not used, the theft is not considered robbery.
Cases of armed robbery are evaluated according to the level of force that was used, not necessarily the value of the property that was stolen. Violence or intimidation must be used prior to the theft for the crime to be classified as robbery. Instances of robbery are further categorized as simple robbery or aggravated robbery. If the robber used a deadly weapon, had an accomplice, or caused bodily injury to the victim, it would be classified as aggravated robbery.
A convicted armed robber is subject to harsh legal consequences. Consequences usually depend upon the amount of force used, the type of weapon used, the offender's prior criminal acts, and if the victim sustained injuries. Any of these circumstances can lead to an enhanced punishment or sentence. Punishments for armed robbery include imprisonment, monetary fines, community service, and probation.
